Upon submission of a completed application, whether “Day Pass”' subscriber or a 'Subscription or Fee Based Service’, (hereafter referred to as 'Member' or ‘Members’), or anyone utilizing any information provided in this site, you hereby agree to the following terms and conditions set forth. TodayTrader is an independent website providing information for day trading ‘Members’, day traders, online trading or momentum traders to share and exchange information on Stock Trading although not limited to Stocks. TodayTrader is not offering to buy or sell Stocks mentioned in any service we offer and is not representing itself as a registered investment advisor or broker dealer. TodayTrader does not guarantee the accuracy or reliability of information, quotes, opinions or advice provided in any of the services offered. All decisions to act upon any suggestions made in any service we offer whether to buy or sell Stocks is the sole responsibility of the 'Members'. TodayTrader does not represent or guarantee that 'Members' acting upon any suggestion mentioned, discussed, or viewed in any of the services we offer, will result in a profit.

TodayTrader’s Services are intended for the sole purpose of day trading demonstrations and education. TodayTrader does not recommend Members buy or sell Stocks when using the Services offered by TodayTrader.  All decisions to act upon anything viewed or heard is at the sole discretion of the Member and TodayTrader assumes no responsibility. TodayTrader is not offering any professional services whatsoever and it is recommended that 'Members' contact a professional advisor of their choice, prior to undertaking trading Stocks. General trading education is highly recommended for all potential 'Members'.

('Member' may hereinafter be referred to as 'I', ‘My’, 'Me', 'Your', 'You') By accepting this disclaimer I acknowledge the risks involved in day trading stocks and are also acknowledge that I, and not TodayTrader, am solely responsible for any losses, financial or otherwise, as a result of using this service. (You should carefully consider your financial condition as to whether trading Stocks is in your best interest). I understand that when I buy or sell Stocks, I can incur a loss of some if not all of my capital, cash and/or assets I may have pledged to buy Stocks. I understand that TodayTrader is not responsible for any trading activities between my broker and me. I understand that under certain Market conditions, it may become difficult for me to liquidate a position and I take full responsibility should this occur. I understand and agree that, should I buy or sell Stocks mentioned or viewed in any of the services offered, I may experience a loss from those trades.  As a trader I agree not to hold TodayTrader or any of its members responsible for my orders placed; my orders filled; my Stocks sold; my Stocks bought; my profits made or my losses incurred. I understand and agree that day trading Stocks can lead to large losses of my cash, capital, or assets and I agree not to hold TodayTrader responsible should I experience any losses. I understand that results anticipated should not be based on the past performance of any of the services offered or videos produced by TodayTrader.

I agree that TodayTrader shall, under no circumstances be liable for any lost profits, lost opportunities, misstatements, or errors contained within the live services. I also understand that TodayTrader will not be held liable for data accuracy, server problems, or any special or consequential damages that result from the use of, or the inability to use, any or all of the materials, or services produced on our Website. You agree to hold TodayTrader harmless for any act resulting directly or indirectly from this site, its data, content, materials, associated pages and documents. I understand that the live services offered by TodayTrader are subject to the limitations of the Internet and its stability. From time to time, the live feed of video and audio may be temporarily disrupted. TodayTrader will always make all reasonable efforts to correct such unforeseen technical problems and restore the live video and audio to its subscribers. TodayTrader is not responsible for any subscription refunds, or prorated refunds due to temporary technical issues beyond the control of TodayTrader.  Such issues could include, but not be limited to: loss of Internet feed on the end of TodayTrader; Loss of Internet feed on the subscriber’s end; Subscriber’s computer speed and or performance limitations. If you are experiencing audio or technical issues. You must immediately contact us for support and workaround solutions.

I understand and agree that TodayTrader in its sole discretion can terminate my Membership for whatever reason and that I will not be entitled to any refund. I understand that I may cancel my membership by the terms set forth on the subscription agreement page. I understand that in the event that I cancel my Membership prior to my current subscription period being used up, I am not entitled to any credits for my unused Membership or subscription term. Reactivation of a canceled membership is based on the sole discretion of TodayTrader and should a membership reactivation be turned down, TodayTrader is under no obligation to provide reasoning for such denial. By using this site, there is no warrant that information contained, obtained or utilized is error or defect free or that servers accessed are free of harm or any viruses. You agree to be responsible for any and all costs that may occur to your computer and all components.

You agree not to duplicate or solicit any information or material from TodayTrader or any of the services we offer without the prior written approval and consent from TodayTrader.

TodayTrader reserves its right to make adjustments to the Membership and Subscription fees at any time it deems necessary and will make an attempt to notify subscribers of any adjustments but, cannot be held responsible if Subscriber does not receive notice. Adequate notice will be given to all members if such a rate increase occurs. 

TodayTrader has a No Tolerance Policy for hyping stocks, abusive or vulgar language, and major disruptions in the Meeting Rooms (integrated audio or chat) and reserves the right to cancel 'Members' if they are found abusing this policy. The control of audio will be at the sole discretion of the Meeting Moderator. The Meeting Moderator will have sole discretion to remove a participant from the room for any reason whatsoever. If the membership is canceled at the discretion of TodayTrader due to violation of this No Tolerance Policy, no refunds or prorated refunds will be given for the remainder of that current month.

The contents on this website are provided "AS IS" without warranties of any kind, either express or implied (including, but not limited to, any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement of third parties' rights). TodayTrader does not warrant that the contents are error-free. TodayTrader will use reasonable efforts to place accurate and up-to-date information on this website but, makes no warranty of its accuracy, completeness and/or timeliness.

TodayTrader is not liable for direct, indirect, incidental, consequential, punitive or other damages (including, but not limited to, economic losses, lost profits, lost revenues or lost data) arising out of the access to or inability to access this website or the Linked Sites, even if advised of the possibility of such damages. Nor is it liable for any laws outside the United States that may limit the service. Any technical service issues must be reported right away in order to find a solution. No refunds will be given for a pro-rated month. Your subscription can be cancelled anytime and will take effect on your next scheduled billing date. Please give at least 10 days notice before your next billing date if you wish to cancel.

Permission is granted to link to this website if you comply with the following linking policy upon your receiving our prior authorization: your site must not slander or damage TodayTrader, its products and/or services, or contain inappropriate content; you may not create a frame around TodayTrader content or create any impression by any other method that the content does not belong to TodayTrader, and you must use and spell our name correctly. This permission terminates automatically if you breach any terms or conditions of these Terms or any applicable terms of use. Upon termination, you must promptly remove any link.

TodayTrader is committed to respecting your privacy and recognizes the importance of the personal data by which you can be identified, such as your name, mailing address and/or Email address ("Personal Data"). In general, you can access and surf TodayTrader without revealing any Personal Data. We do track the Internet address of people who visit TodayTrader and analyze this data for trends and statistics. The tracked data does not include your Personal Data, unless it is requested and supplied by you when you accept special offers from our advertisers.

If you do not provide the information we request, you can still visit most of our website however, you may be unable to access certain options, special offers and/or services.
